Terms & Conditions

1. Scope

These terms and conditions apply to all photography bookings between Clarissa Chesterton, Stadelmannstraße 6, 63739 Aschaffenburg, Germany ("I/me") and my clients ("you"), unless otherwise agreed in writing.

2. Booking & contract

A contract is formed once I confirm an inquiry in writing (e.g. by email). A session is only considered booked once this confirmation has been sent. For some sessions a deposit may be agreed to secure the date, which will be deducted from the final invoice.

3. Fees & payment

Fees are based on the agreed package or individual quote. Invoices are issued after the session or upon delivery of the photos, unless otherwise agreed. As a small business under § 19 UStG (German VAT act), no VAT is shown on invoices.

4. Rescheduling & cancellation

Sessions can be rescheduled or cancelled free of charge up to 7 days before the agreed date. For shorter notice or no-shows, I may retain a reasonable part of the fee or any deposit paid as compensation. Outdoor sessions can be rescheduled free of charge by mutual agreement in case of bad weather.

5. Delivery of images

Edited images are usually provided digitally (e.g. via a download link) within the timeframe stated in the relevant offer. The selection of delivered images and the style of editing reflect my artistic judgement. Delivery of unedited raw files is not part of the service.

6. Usage rights

Upon full payment, you receive a simple, unlimited usage right to the delivered images for private purposes. Commercial use (e.g. advertising, corporate publication) requires a separate agreement. Copyright remains with me as the photographer at all times, in accordance with German copyright law.

7. Publication & portfolio use

Unless you object, I may use selected images from your session for my own promotional purposes, e.g. on my website or Instagram. If you would prefer this not to happen, simply let me know before or immediately after the session and your images will not be published.

8. Liability

I am only liable for damages arising from intentional or grossly negligent breaches of duty, as well as for damages resulting from injury to life, body or health. For loss of data (e.g. due to a technical defect during or after the session) I am only liable in cases of gross negligence or intent.

9. Final provisions

These terms are governed by the law of the Federal Republic of Germany. Should any provision be invalid, the validity of the remaining provisions remains unaffected.
